US House Committees Advance Major Bitcoin Reserve and Crypto Tax Bills

The US House committees have advanced two major crypto bills, including the American Reserve Modernization Act to establish a strategic Bitcoin reserve and the Digital Asset Tax Certainty Act to clarify federal tax rules.

A significant development in digital currencies took place in the US Congress as two legislative initiatives concerning Bitcoin and crypto taxation advanced through House committees. These moves could deepen the integration of digital assets into the US financial and legal framework.

According to a report by Crypto Jungle, the House Financial Services Committee approved the American Reserve Modernization Act by a vote of 28 to 21. The proposal seeks to enshrine the strategic Bitcoin reserve in law and establish a dedicated framework within the US Treasury Department to manage the government-held Bitcoin, alongside a separate pool for other digital assets. The proposal primarily addresses assets acquired by the government through criminal and civil forfeiture proceedings.

Reserve Structure and Regulations

Under the proposal, the Bitcoin held in the reserve will be subject to a 20-year holding period. In addition, the legislation aims to create oversight and reporting mechanisms for government holdings. It is important to emphasize that the version passed by the committee does not include a plan for the immediate purchase of one million Bitcoins on the open market. Rather, it focuses on regulating existing holdings and examining additional acquisition strategies.

The move also sparked political controversy. Proponents of the bill, including its initiator Nicholas Begich, argued that centralizing the management of the government's Bitcoin assets could reduce risks and improve oversight. Conversely, Democratic members of the committee expressed reservations regarding Bitcoin's volatility and its significance for the US economy. To become law, the proposal still needs to pass the House floor and subsequently the Senate.

Crypto Tax Reform

Simultaneously, the House Ways and Means Committee advanced the Digital Asset Tax Certainty Act. The bill seeks to establish a clearer federal framework for taxing digital assets, including exemptions and reporting for small transactions, rules concerning stablecoins, and the application of existing tax rules to digital assets.

The legislation also addresses the taxation of mining and staking activities, as well as wash sale rules designed to prevent the use of transactions for tax planning purposes. Alongside this, some provisions concerning the taxation of rewards from mining and staking activities underwent modifications during committee deliberations.

Both developments mark the continued transition of crypto from an emerging technological arena into a subject examined as part of the US legal and financial policy system. If the legislation progresses through the next stages, it could create a clearer framework surrounding how the government holds Bitcoin and how digital assets are taxed.

However, at this stage, these are legislative proposals that have passed congressional committees rather than final, binding legislation.
