A Traffic Court in the Central District has acquitted a female driver who was charged with causing a traffic accident that resulted in injuries to a motorcyclist. Judge Magi Cohen ruled that in the absence of objective evidence supporting either party's version of events, it is impossible to determine criminal liability.

The collision occurred in September 2023 within an urban area, involving a passenger car and a motorcycle traveling in the same direction. According to the indictment, the driver attempted to execute a U-turn without ensuring the maneuver would not obstruct traffic or endanger other road users, thereby cutting off the motorcycle and causing the crash.

Conflicting Versions and Court Findings

The motorcyclist testified that the car in front of him initially signaled right before suddenly swerving left, causing him to collide with the vehicle. He denied attempting an illegal overtake and maintained he kept a safe following distance. Conversely, the driver stated she was searching for parking and decided to make a U-turn after spotting a space across the street. She asserted she slowed down, signaled, checked her mirrors, and claimed the motorcyclist simply failed to maintain an adequate distance.

Judge Cohen highlighted the lack of objective evidence or independent eyewitnesses. The traffic accident investigator admitted in court that he did not arrive at the scene in real time, performed no reconstruction, and could not conclusively determine fault or explain the exact mechanics of the impact.

«A judge is flesh and blood and has only what their eyes see and ears hear. After examining the prosecution's evidence against the defendant's testimony, a reasonable doubt remains regarding her responsibility for the accident,» Judge Cohen concluded, acquitting the motorist of all charges.
