The legal battle between Oscar-winning actress Halle Berry and her ex-husband, French actor Olivier Martinez, has escalated significantly after Martinez filed for a temporary restraining order in Los Angeles. Martinez alleged that Berry physically attacked their 12-year-old son, Maceo, prompting a court to temporarily order Berry to stay 90 meters away from Martinez and restrict her visitation rights ahead of a hearing scheduled for October 16.

The Alleged Incident

According to court documents filed by Martinez, the incident occurred on Saturday, September 26, at Berry's home while Maceo was playing a virtual reality game. Martinez claims that Berry entered the room, mocked her son over the game, and the confrontation eventually turned physical. He alleged that Berry lunged at the boy, grabbed him by the neck, and choked him while shouting, "Who's in control now?! Who's in control?!" Berry has strongly denied the accusations.

Martinez stated that his son called him in a state of distress, pleading to be picked up. The documents include text messages allegedly sent by Maceo asking his father to rescue him immediately. Martinez argued that his son is now afraid to stay at his mother's home and fears the incident has caused lasting trauma. Furthermore, Martinez alleged this is not an isolated event, accusing Berry of physically struggling with their son on multiple occasions over the past year and a half, sometimes pinning him to the ground. He is now seeking sole custody of Maceo.

Berry's Response and Legal Outlook

Berry's attorney, Marina Beck, vehemently rejected the allegations, stating that the request is entirely baseless and intentionally misleading. Beck accused Martinez of previously violating court orders, interfering with Maceo's treatments and educational frameworks, and exhibiting possessive and unstable behavior. Berry maintains her commitment to her son's well-being.

The Los Angeles court did not grant all of Martinez's demands, allowing Berry to continue seeing her son under restricted visitation terms, while a request for sobriety monitoring was denied due to insufficient evidence. Both parties have been ordered to participate in confidential custody mediation as the temporary order remains in place pending the upcoming hearing.
