Tel Aviv District Court Convicts Man of Aggravated Murder
The Tel Aviv District Court unanimously convicted 40-year-old Sudanese citizen Hussein Atiyeh of the aggravated murder of another Sudanese national, Musa Muhammad, along with weapons charges and obstruction of justice. The mandatory sentence for aggravated murder is life imprisonment.
According to the indictment, the incident took place on September 30, 2023. Atiyeh left his apartment on Chelnow Street in Tel Aviv-Yafo wearing a Wolt delivery jacket, a helmet, and a black face mask, riding an electric bicycle equipped with a stolen delivery box. He carried a 9mm pistol in a front bag.
The Shooting and Evacuation
The defendant rode to Har Zion Street, where the victim was sitting near a shop. Atiyeh dismounted, drew the weapon, and shot Muhammad multiple times at close range. Despite resuscitation efforts by MDA (Magen David Adom) paramedics who arrived at 06:01, the victim was rushed to Ichilov Hospital, where his death was pronounced at 06:50.
"The prosecution has met the required burden of proof under criminal law," wrote Judge Yosef Topf, noting that the defendant's guilt was established through continuous CCTV footage, DNA evidence on the face mask, and gunshot residue findings.
The judges—Yosef Topf, Oded Maor, and Maayan Ben-Ari—rejected the defendant's alternative explanations, ruling that the physical and scientific evidence established his culpability beyond a reasonable doubt.
