MK Sami Abu Shehadeh, chairman of the Balad party, became the center of a legal and public storm following an article he published on October 8, 2023, in which he described the events of October 7 as a "historic and strategic event." Following the publication, various parties and politicians petitioned the Supreme Court, including Minister of National Security Itamar Ben Gvir from the Otzma Yehudit party, requesting his disqualification from the Knesset.

The Supreme Court held a hearing on Thursday with a panel of nine justices regarding the Central Election Committee's decisions to bar Sami Abu Shehadeh from running in the Knesset elections. In the background of the hearing was the support of Attorney General Gali Baharav-Miara and State Attorney Amit Aisman for disqualifying the Balad chairman from the Knesset race.

Legal Arguments and Reactions

Abu Shehadeh's representative, Adv. Hassan Jabarin, stated during the hearing that the statement claiming "October 7 is a historic and strategic event" does not constitute support for armed struggle. He later noted: "I agree with the Attorney General that the article should not have been published and the timing was poor."

Minister Itamar Ben Gvir responded sharply outside the courtroom:

Just as we ousted Sami Abu Shehadeh from the Knesset, so we will oust Ahmad Tibi and all the haters of Israel in the Knesset. We did everything to ensure Sami Abu Shehadeh would not be in the Knesset. Thank God, we won.

Court Proceedings and Further Statements

During the Supreme Court hearing, Justice Yitzhak Amit addressed MK Abu Shehadeh, stating that there is a consensus among the judges that certain things written by the candidate are outrageous and elicit revulsion. The emerging outcome points toward upholding the disqualification decision.

Meanwhile, MK Ahmad Tibi rushed to defend Sami Abu Shehadeh, attacking the judges' decision: "This is a black day. The goal of those seeking disqualification is to harm the high voter turnout in Arab society."
