Tel Aviv Court Sentences Man for Assaulting Protester Carrying Israeli Flag

The Tel Aviv Magistrate's Court has sentenced 26-year-old Liel Shamir to 250 hours of community service, probation, a fine, and 6,000 shekels in compensation for assaulting a protester in Ramat Gan over three years ago.

According to the indictment, in which Shamir pleaded guilty as part of a plea agreement, the victim, identified as Berkovich, was walking down Shalom Zisman Street in Ramat Gan with his wife, Anat, while carrying an Israeli flag on a pole. The couple was heading toward an evening demonstration in Tel Aviv.

At that moment, Shamir was driving in a Toyota with four friends. Upon spotting Berkovich and the flag, the occupants of the vehicle began shouting insults. One passenger threw a glass bottle toward the pedestrian, which shattered on the ground.

Escalation and Physical Assault

Following the provocation, Berkovich approached the vehicle. Shamir and his friends exited the car, leading to a physical confrontation. During the clash, Shamir punched Berkovich twice in the face. The victim attempted to defend himself using the flagpole, striking Shamir on the hand and neck. Berkovich sustained injuries during the assault and subsequently sought medical treatment at Ichilov Hospital.

The prosecution requested several months of prison time to be served via community service, alongside a significant fine. Conversely, Shamir's defense attorney urged the court to avoid a formal conviction, pointing to his client's clean record, his remorse, and a low risk of reoffending. The defense also noted that the case against the victim had been closed and that Shamir was merely on his way to a concert with friends.

Court Ruling and Sentencing

Judge Anat Yahav rejected the defense's request to clear Shamir's record, emphasizing the severity of the public violence.

Judge Yahav stated:

"This was a thuggish, violent, and ugly incident. The victim, who was alone, found himself facing five individuals, tried to protect himself, was injured, and required medical evacuation. I must express my utter disgust at this behavior, which reflects a breakdown of fundamental values, including respect for others' opinions and the legal right to express them."

In determining the sentence, the judge took into account Shamir's young age, his lack of prior convictions, his confession, and the time elapsed since the offense. Shamir was sentenced to 250 hours of community service over one year, a 1,000-shekel fine, and 6,000 shekels in compensation to the victim.
