"For the sake of caution": Barak-Erez froze the transfer of the Military Advocate General's case to the State Attorney

The Supreme Court judge ordered a temporary halt to the transfer of the case to Amit Aisman. The decision was made two weeks after the High Court of Justice rejected a petition on the matter, which led to a request for a further hearing.

Supreme Court Judge Dafna Barak-Erez decided today (Friday) to temporarily freeze the transfer of the handling of the former Military Advocate General Yifat Tomer-Yerushalmi's case to State Attorney Amit Aisman. Barak-Erez determined that the freeze would be "for the sake of caution only" and until further notice, emphasizing that her decision does not constitute taking a position regarding the request for a further hearing filed in the case.

The decision was made after the original petitioners — MK Avichai Boaron, the "We Chose Life" organization, and the Lavi organization — filed a request for a further hearing on the verdict given about two weeks ago. The request was transferred to Barak-Erez for handling.

The case concerns the investigation into the leak of a video from security cameras at the Sde Teiman facility to the media, suspicions of filing false affidavits to the High Court of Justice, and the cover-up of the investigation regarding the leak. The criminal investigation focused, among others, on former Military Advocate General Tomer-Yerushalmi and other officers in the Military Advocate General's Corps. In October 2025, Tomer-Yerushalmi informed the Chief of Staff that she had approved the transfer of materials to the media and bears responsibility for it, and subsequently ended her role.

The handling of the case was accompanied by controversy over the identity of the body that would oversee the investigation. In November 2025, the High Court of Justice ruled that under the circumstances that had arisen, the oversight of the investigation should not be transferred to senior officials of the Attorney General's Office or the State Attorney's Office, and that an external party should be allowed to be appointed to oversee it.

In March 2026, the Legal Advisor to the Ministry of Justice, Yael Kotik, determined that there was no longer any impediment to transferring the investigation materials to the State Attorney for handling. Kotik determined that Amit Aisman would handle the case, and he or his representatives would decide whether to file indictments. The petitioners opposed the transfer of the case to Aisman, arguing that there was a conflict of interest for the State Attorney's Office. In the verdict given about two weeks ago, the High Court of Justice rejected the petition and ruled that there should be no interference with the position that Aisman is permitted to deal with the case, after the police investigation did not reveal information about significant involvement of his in the case.
